CONDITIONS DE VENTE
STANISLAS MACHOÏR est une Société de Ventes Volontaires (SVV) aux Enchères Publiques, sous le numéro 2002/384 et régie par la loi française.
Le procès-verbal de la vente sera tenu par le ministere de Me. Thierry COLLARD, huissier de justice à Liège (Verviers).
Le Commissaire-Priseur dirige les ventes en français et selon la pratique établie des ventes aux enchères. La traduction des descriptions en anglais ou autre langue n’est donnée qu’à titre indicatif. Il se réserve le droit d’organiser le déroulement de la vente et des enchères, de modifier le cours de la vente, de retirer tout lot de la vente, de réunir (faculté de réunion) ou de séparer des lots. En cas de contestation, le Commissaire-Priseur se réserve le droit de poursuivre ou d’annuler la vente d’un lot, ou encore de le remettre en vente en cas de conflit entre plusieurs enchérisseurs. En cas de double enchère reconnue effective par le commissaire-priseur, l’objet sera remis en vente, tous les amateurs présents pouvant concourir à cette deuxième mise en adjudication.
LE CATALOGUE
La description figurant dans ce catalogue sera rédigée en français. Les lots sont vendus en l’état. Les indications et les estimations données au catalogue le sont à titre indicatif uniquement.

Certains lots pourront être ajoutés à la vente sans être inclus dans le catalogue. Une liste supplémentaire sera affichée et à disposition du public pendant les journées d’expositions et annoncée avant la vente.

Tout bien meuble ou véhicule à moteur inclus dans le catalogue en vue de sa vente aux enchères.
ENCHERES
Tous les acheteurs potentiels sont priés de se présenter au moins 1h avant la vente avec un justificatif d’identité auprès du Secrétariat. En s’enregistrant, les enchérisseurs acceptent avoir lu et accepté les conditions de la vente. Un numéro lui sera remis qui lui permettra de participer en tant qu’enchérisseur.
Dans l’hypothèse où l’adjudicataire ne se sera pas fait enregistrer avant la vente, il devra communiquer les renseignements nécessaires dès l’adjudication du lot prononcée. Toute personne s’étant fait enregistrer auprès de la SVV dispose d’un droit d’accès et de rectification aux données nominatives fournies à la SVV dans les conditions de la Loi du 6 juillet 1978.
Les enchères peuvent être portées personnellement lors de la vente, par téléphone ou en adressant au Commissaire-Priseur un ordre d’achat. Tout le monde, peut se porter enchérisseur à condition d’être majeur, responsable, solvable et avoir pris connaissance des conditions de vente figurant dans le catalogue de vente. Tout enchérisseur est censé agir pour son propre compte sauf dénonciation préalable de sa qualité de mandataire pour le compte d’un tiers, accepté par le commissaire-priseur.
ENCHERES PAR TELEPHONE
Le Commissaire-Priseur accepte gracieusement de recevoir des enchères par téléphone d’un acquéreur potentiel qui se sera manifesté avant la vente. Les ordres d’achat doivent nous parvenir au plus tard une heure avant la vente et doivent être confirmés par téléphone.
La SVV ne saurait être responsable notamment si la liaison téléphonique n’est pas établie, ou établie tardivement. Aucune garantie n’est donnée quant à la suite des ordres reçus par email, en raison de l’incertitude, sur la garantie de l’émetteur. Si le Commissaire-priseur reçoit plusieurs ordres pour des montants des enchères identiques, c’est l’ordre le plus ancien qui sera préféré.
PRIX DE RESERVE
Tous les lots ont un prix de réserve (sauf si le contraire a été établi) qui est le minimum au-dessous de quoi le lot ne peut pas être adjugé.
Les lots portant l’astérisque (*) sont vendus sans prix minimum de réserve fixé par le vendeur. Le Commissaire-Priseur décide de la mise à prix qui sera en dessous des estimations données à titre indicatif de la valeur du lot. Sans enchères à la mise à prix, le lot sera « retiré faute d’enchère ».
Dans l’hypothèse où un prix de réserve aurait été stipulé par le vendeur, la SVV, se réserve de porter des enchères pour le compte du vendeur jusqu’à ce que le prix de réserve soit atteint. En revanche, le vendeur ne sera pas admis à porter lui-même des enchères directement ou par mandataire.
MISE À PRIX
La mise à prix est le point de départ des enchères. Elle est fixée à l’entière discrétion du commissaire-priseur.
L’ADJUDICATION DU LOT
L’adjudicataire sera la personne qui aura porté l’enchère la plus élevé. Le coup de marteau du commissaire-priseur suivi de la phrase ‘adjugé’ matérialise l’adjudication du lot. L’adjudicataire ne pourra obtenir la livraison du lot qu’après règlement du lot. En cas de remise d’un chèque ordinaire, seul l’encaissement du chèque vaudra règlement.
PRIX D’ADJUDICATION OU PRIX MARTEAU
Le prix hors frais, auquel un lot est attribué par le commissaire-priseur à l’acheteur.
REGLEMENTS ET TVA
La vente est faite au comptant et conduite en euros [€]. Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix de l’adjudication, ainsi que les frais et taxes exigibles. Il ne sera délivré aucun document faisant ressortir la TVA.
FRAIS D’ADJUDICATION
Les acquéreurs paieront, en sus de l’adjudication (prix marteau) le prix principal augmenté des frais légaux, selon les modalités du décret n° 2002-210 – J.O. du 19 février 2002 : Automobilia : 20,00% (frais de vente) + TVA (20%) = 24% TTC.
Automobiles : 16,66% (frais de vente) + TVA (20%)= 20% TTC.
En cas d’enchère remportée via le site internet de DROUOT LIVE, une commission de 2% HT sur le prix d’adjudication sera facturée
Un bordereau d’acquisition vous sera remis à la fin de la vente. Pour les acquéreurs à distance, il vous sera envoyé par mail au plus tôt ainsi que par courrier le lendemain de la vente.
TVA
Lorsque le bien vendu doit être exporté vers un pays tiers de l’UE, l’acheteur doit le signaler au commissaire-priseur. STANISLAS MACHOÏR décline toute responsabilité sur les conséquences juridiques et fiscales d’une fausse déclaration de l’acheteur.
RÈGLEMENT
En espèces : 1000€ pour les résidents français (frais et taxes compris) et 15 000€ (frais et taxes compris) pour les ressortissants étrangers sur présentation des documents d’identité.

PREEMPTION
L’État français dispose d’un droit de préemption sur les biens meubles présentés en vente aux enchères publiques. L’exercice de ce droit s’effectue par l’intermédiaire d’un représentant de l’État. L’État se substitue alors au dernier enchérisseur et dispose de 15 jours pour confirmer ce droit de préemption.
PROCEDURE DE FOLLE ENCHERE
À défaut de paiement par l’adjudicataire, après mise en demeure, le lot sera remis en vente à la demande du vendeur dans le cadre de la procédure connue comme ‘folle enchère’ de l’adjudicataire défaillant. Si le vendeur ne formule pas cette demande dans un délai d’un mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice des dommages intérêts dus par l’adjudicataire défaillant.
En outre, STANISLAS MACHOïR se réserve de réclamer à l’adjudicataire défaillant, à son choix : 1.des intérêts au taux légal, 2. le remboursement des coûts supplémentaires engendrés par sa défaillance ? 3. le paiement de la différence entre le prix d’adjudication initial et le prix d’adjudication sur folle enchère s’il est inférieur, ainsi que les coûts générés par les nouvelles enchères.
La SVV se réserve également de procéder à toute compensation avec des sommes dues à l’adjudicataire défaillant. Il est vivement demandé aux adjudicataires de procéder à un enlèvement le plus rapide possible de leurs achats, afin de limiter les frais de stockage qui sont à leur charge.
TRANSPORT
Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. L’enlèvement et le transport des lots acquis sont à la charge exclusive de l’acheteur.
Les voitures doivent être assurées par leur propriétaire, qui est responsables de tout dégât occasionnée par leur véhicule.
ASSURANCE
Il appartiendra exclusivement à l’acquéreur de faire assurer les lots dès l’adjudication. FEE-STANISLAS MACHOÏR décline toute responsabilité quant aux dommages que l’objet pourrait encourir, et ceci dès l’adjudication prononcée.
DOMMAGES
Toute personne portant un dommage sur un lot pendant l’exposition ou lors de la vente sera tenue légalement responsable.
PROPRIETE INTELLECTUELLE
La SVV est propriétaire du droit de reproduction de son catalogue. Toute reproduction de celui-ci est interdite et constitue une contrefaçon à son préjudice.
La SVV dispose d’une dérogation légale leur permettant de reproduire dans son catalogue les œuvres mises en vente, alors même que le droit de reproduction ne serait pas tombé dans le domaine public.
La vente d’une œuvre n’emporte pas au profit de son propriétaire le droit de reproduction et de représentation de l’œuvre. Toutes les illustrations, photographies et les informations fournies par le vendeur peuvent être utilisés par le Commissaire-Priseur à son entière discrétion afin de promouvoir la publicité des lots. Néanmoins, il est strictement interdit de photographier ou filmer le déroulement de la vente. Les photographies prises pendant l’exhibition sont autorisées dans le cadre de la copie privée.
JURIDICTION
Indépendance des dispositions : Toutes les dispositions des conditions de vente de ce catalogue sont complètement indépendantes les unes des autres. La nullité de quelque disposition ne saurait entraîner l’inapplicabilité des autres.
En cas de litige relatif à sa validité et exécution, les Parties se soumettent à la loi française et à leur exécution par les Tribunaux compétents de Toulouse.
CONDITIONS OF SALE
STANISLAS MACHOÏR is an Auction House, registered under the number 2002/384 and regulated by the french law (July 2000).
- THE AUCTIONEER: will conduct the auction in French and in accordance with established practice concerning auctions. The descriptions in English are given for illustrative purposes only and in case of dispute the French description will prevail. The Auctioneer reserves himself the right to organize and conduct the sale, to modify the course of the sale, to withdraw any lot from sale, to bring together or separate lots. In case of a dispute, the Auctioneer reserves himself the right to continue or cancel the sale of a lot, or to put a lot back up in the event of conflict between several bidders. In case of several bids effectively recognized by the auctioneer, the lot will be put back up for bidding; all potential buyers may participate bidding at that time.
-CATALOGUE: The description in this catalog will be written in French. All lots are sold in current conditions. The description, general conditions, the verbal statement as well as the estimate given in the catalog are given as the expression by STANISLAS MACHOÏR of the perception of the lot but cannot constitute the proof of a fact.
-LOTS NON INCLUDED IN THE CATALOGUE: Some lots may be added to the sale without being included in the catalog. A supplementary list will be post during the exhibition and announced before the sale began.
-VIEWING : The viewing is open to the public. This exhibition allows bidders to appreciate and examine any condition of the lots. STANISLAS MACHOÏR is at disposal of potential buyers to provide reports on conditions of the lots. No claims will be accepted once the hammer falls. Any amendment will be posted during the public exhibition and announced before the sale begins.
-THE SALE : All potential buyers are request to register at the front desk at least an hour before the sale takes place. By registering, bidders agree to have read and accepted the conditions of the sale. A registration number will be provided allowing you to participate by bidding.
Any person is deemed acting on his own behalf except when prior notification, accepted by STANISLAS MACHOÏR is given that he acts as an agent of a third person. Bids can be executed at the sale’s room, by phone (telephone bids) or through the absentee bid form. Any person presenting himself as a bidder should have read and accept the terms and conditions of this catalog.
-COMMISSIONS: The Auctioneer will be pleased to execute Commissions, on conditions the lots have been viewing by the intended purchaser or his authorized Agent. Lots will be procured as cheaply as is permitted by other bids. All Lots bought on commission must be paid for within 7 days of the date of sale, regardless whether or not they have been collected.
-BIDDING BY TELEPHONE: STANISLAS MACHOÏR may graciously accept to receive bids by telephone from a potential buyer who has expressed such a request before the sale. Telephone bid orders must be submitted at least one hour before the sale. STANISLAS MACHOÏR will bear not liability or responsibility whatsoever in the event of telephone malfunction or when the communication breaks down. No guarantee is made as a result of orders received by mail, because of uncertainty about the security of the issuer.
-ABSENTEE BID FORM : This form is an authorization from the buyer to purchase under the best conditions on his behalf. This form should be accompanied by your ID, your bank details, as well as the maximum bid in euros for each lot (ex. Premium buyers and VAT). The absentee bid order form should be sent by fax or by mail at least one hour before the sale. If you are the successful bidder, we will contact you at the end of the sale. If the auctioneer receives multiple bid orders regarding identical bids, priority should be given to the first form received. Telephone bids may be arranged for lots with a low estimate of at least 1500 euros.
-SUCESSFUL BIDDER : The successful bidder is the person who brought the highest bid equal or higher than the reserve price (if stipulated). The auctioneer hammer’s stroke followed by the word 'adjugé' materializes the sale of the lot.
The full payment is the mandatory condition to deliver the lot to the successful bidder.
-CLEARANCE: Purchased Lots should be cleared on the day of the sale or the day following. Any Lot remaining o the Premises after 10 working days will be removed to the Auction Storage entirely at the owners risk and expenses.
- PACKING&SHIPPING: We do not undertake the postage, packing or delivery of items, but we recommend for such operations to be carried out by trusted collectors. If you wish to have your items for auction collected, we are happy to arrange this for you.
-RESERVE PRICE: All lots have a reserve price (unless the opposite has been established) which is the confidential minimum price below which the lot shall not be sold. Certain lots may be put forward without reserve and they shall be marked with an asterisk(*)followed by the sentence ‘sans reserve’. The Auctioneer decides at its sole discretion the starting price which is generally below the low estimate. In the event of a lacking of bidding, the lot will be withdrawn of the sale. In the event that a reserve price has been stipulated by the seller, STANISLAS MACHOÏR, reserves itself the right to bid on behalf of the seller until the reserve price is reached.
-SETTING A PRICE: The starting price is the starting point of the auction. There is no connection between the starting price, reserve price and the low estimate.
HAMMER PRICE AND THE BUYERS PREMIUM: The hammer price represents the last bid which marks the materialization of the sale between the seller and the buyer In addition to the hammer price the buyer’s agrees to pay STANISLAS MACHOÏR a premium of 24% on the hammer price (VAT included) on automobilia lots and 20% (VAT INCLUDED) for the motos and vehicles.
-PAYMENT AND VAT: The sale shall be executed in euros [€]. Anyone who is a bidder agrees to pay personally and immediately the total purchase price, as well as the applicable fees and taxes.
-BUYER’S PREMIUM: In addition to the hammer price, buyers agree to pay a Premium. (Decree No. 2002-210 – OJ February 19th, 2002).

In case of an auction won via the website of DROUOT LIVE, a commission of 2% + VAT on the auction price will be invoiced
An invoice shall be issued at the end of the sale. For absentee buyers, it will be sent by mail and by fax at the earliest and by post mail a day after the sale. VAT In the event that a lot might be exported to a country outside the EU, the owner shall notify the auctioneer as soon as the lot is sold.
STANISLAS MACHOÏR disclaims any responsibility for legal consequences of a buyer’s false statement.
-PAYMENT: By French check: STANISLAS MACHOÏR accepts only checks in euro. Lots will be only delivered after effective receipt of the payment. The transfer of ownership will be made by STANISLAS MACHOÏR after the total and effective payment.
a) In cash in euros within the following limits:
1000 € for French residents and traders (including fees and taxes)
- 15000€ (including fees and taxes) for all those persons not having its residence in France for tax purpose, upon presentation of official proof of identity and address.
b) By transfer in euros: our bank references will be given to the buyer directly.
All cost, such as bank commissions should be paid by the buyer.
-PRE-EMPTION: The French state has a right of pre-emption on movable property put up for sale at public auctions. This right shall be effective via a representative from the State. The State then replaces the last bidder and has 15 days to confirm the right of preemption.
-‘FOLLE ENCHERE’ PROCEDURE: Should the buyer fail to pay the amount due, and after notice, the lot will be re offered sale at the seller's request under the procedure known as procedure de folle enchère (irresponsible bidding). If the seller does not formulate this request within one month after the auction, the sale will be automatically canceled, without prejudice to any damages owed by the defaulting buyer.
-TRANSPORTATION: The removal and transport of lots purchased are the sole responsibility of the buyer. However, STANISLAS MACHOÏR may invoice to the buyer applicable costs of storage, handling and transport. STANISLAS MACHOÏR disclaims for any responsibility of the lot, as it is under the exclusive responsibility of the buyer. STANISLAS MACHOÏR will not be liable in the event or through theft, loss or degradation of any lot.
-INSURANCE: The lots acquired shall be insured by the buyer exclusively and immediately after the sale. STANISLAS MACHOÏR disclaims all liability for damages that may occur from the moment the sale was pronounced by the auctioneer.
-DAMAGES: Any person damaging a lot during the pre-sale viewing or during the sale will be held legally responsible.
INTELLECTUAL PROPERTY: STANISLAS MACHOÏR is the owner of the copyright in its catalogs. All illustrations, images and information provided by the seller may be used by STANISLAS MACHOÏR at its sole discretion in order to advertise the sales and the lots. Nevertheless, it is strictly forbidden to photograph or film the progress of the sale.
Photographs taken during the exhibition are permitted only for private use. Videos are not allowed.
-JURISDICTION All terms and conditions in this catalog are completely independent from each other. In case of dispute regarding its validity and execution, the parties submit themselves to French law and their enforcement by the competent courts in Toulouse, France. In case of conflict between the two versions, the text on French version will prevail.

Les lots portant l’astérisque (*) sont vendus sans prix minimum de réserve fixé par le vendeur. Le Commissaire-Priseur décide de la mise à prix qui sera en dessous des estimations données à titre indicatif de la valeur du lot. Sans enchères à la mise à prix, le lot sera « retiré faute d’enchère ».
Dans l’hypothèse où un prix de réserve aurait été stipulé par le vendeur, la SVV, se réserve de porter des enchères pour le compte du vendeur jusqu’à ce que le prix de réserve soit atteint. En revanche, le vendeur ne sera pas admis à porter lui-même des enchères directement ou par mandataire.
MISE À PRIX
La mise à prix est le point de départ des enchères. Elle est fixée à l’entière discrétion du commissaire-priseur.
L’ADJUDICATION DU LOT
L’adjudicataire sera la personne qui aura porté l’enchère la plus élevé. Le coup de marteau du commissaire-priseur suivi de la phrase ‘adjugé’ matérialise l’adjudication du lot. L’adjudicataire ne pourra obtenir la livraison du lot qu’après règlement du lot. En cas de remise d’un chèque ordinaire, seul l’encaissement du chèque vaudra règlement.
PRIX D’ADJUDICATION OU PRIX MARTEAU
Le prix hors frais, auquel un lot est attribué par le commissaire-priseur à l’acheteur.
REGLEMENTS ET TVA
La vente est faite au comptant et conduite en euros [€]. Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix de l’adjudication, ainsi que les frais et taxes exigibles. Il ne sera délivré aucun document faisant ressortir la TVA.
FRAIS D’ADJUDICATION
Les acquéreurs paieront, en sus de l’adjudication (prix marteau) le prix principal augmenté des frais légaux, selon les modalités du décret n° 2002-210 – J.O. du 19 février 2002 : Automobilia : 20,00% (frais de vente) + TVA (20%) = 24% TTC.
Automobiles : 16,66% (frais de vente) + TVA (20%)= 20% TTC.
En cas d’enchère remportée via le site internet de DROUOT LIVE, une commission de 2% HT sur le prix d’adjudication sera facturée
Un bordereau d’acquisition vous sera remis à la fin de la vente. Pour les acquéreurs à distance, il vous sera envoyé par mail au plus tôt ainsi que par courrier le lendemain de la vente.
TVA
Lorsque le bien vendu doit être exporté vers un pays tiers de l’UE, l’acheteur doit le signaler au commissaire-priseur. STANISLAS MACHOÏR décline toute responsabilité sur les conséquences juridiques et fiscales d’une fausse déclaration de l’acheteur.
RÈGLEMENT
En espèces : 1000€ pour les résidents français (frais et taxes compris) et 15 000€ (frais et taxes compris) pour les ressortissants étrangers sur présentation des documents d’identité.

PREEMPTION
L’État français dispose d’un droit de préemption sur les biens meubles présentés en vente aux enchères publiques. L’exercice de ce droit s’effectue par l’intermédiaire d’un représentant de l’État. L’État se substitue alors au dernier enchérisseur et dispose de 15 jours pour confirmer ce droit de préemption.
PROCEDURE DE FOLLE ENCHERE
À défaut de paiement par l’adjudicataire, après mise en demeure, le lot sera remis en vente à la demande du vendeur dans le cadre de la procédure connue comme ‘folle enchère’ de l’adjudicataire défaillant. Si le vendeur ne formule pas cette demande dans un délai d’un mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice des dommages intérêts dus par l’adjudicataire défaillant.
En outre, STANISLAS MACHOïR se réserve de réclamer à l’adjudicataire défaillant, à son choix : 1.des intérêts au taux légal, 2. le remboursement des coûts supplémentaires engendrés par sa défaillance ? 3. le paiement de la différence entre le prix d’adjudication initial et le prix d’adjudication sur folle enchère s’il est inférieur, ainsi que les coûts générés par les nouvelles enchères.
La SVV se réserve également de procéder à toute compensation avec des sommes dues à l’adjudicataire défaillant. Il est vivement demandé aux adjudicataires de procéder à un enlèvement le plus rapide possible de leurs achats, afin de limiter les frais de stockage qui sont à leur charge.
TRANSPORT
Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. L’enlèvement et le transport des lots acquis sont à la charge exclusive de l’acheteur.
Les voitures doivent être assurées par leur propriétaire, qui est responsables de tout dégât occasionnée par leur véhicule.
ASSURANCE
Il appartiendra exclusivement à l’acquéreur de faire assurer les lots dès l’adjudication. FEE-STANISLAS MACHOÏR décline toute responsabilité quant aux dommages que l’objet pourrait encourir, et ceci dès l’adjudication prononcée.
DOMMAGES
Toute personne portant un dommage sur un lot pendant l’exposition ou lors de la vente sera tenue légalement responsable.
PROPRIETE INTELLECTUELLE
La SVV est propriétaire du droit de reproduction de son catalogue. Toute reproduction de celui-ci est interdite et constitue une contrefaçon à son préjudice.
La SVV dispose d’une dérogation légale leur permettant de reproduire dans son catalogue les œuvres mises en vente, alors même que le droit de reproduction ne serait pas tombé dans le domaine public.
La vente d’une œuvre n’emporte pas au profit de son propriétaire le droit de reproduction et de représentation de l’œuvre. Toutes les illustrations, photographies et les informations fournies par le vendeur peuvent être utilisés par le Commissaire-Priseur à son entière discrétion afin de promouvoir la publicité des lots. Néanmoins, il est strictement interdit de photographier ou filmer le déroulement de la vente. Les photographies prises pendant l’exhibition sont autorisées dans le cadre de la copie privée.
JURIDICTION
Indépendance des dispositions : Toutes les dispositions des conditions de vente de ce catalogue sont complètement indépendantes les unes des autres. La nullité de quelque disposition ne saurait entraîner l’inapplicabilité des autres.
En cas de litige relatif à sa validité et exécution, les Parties se soumettent à la loi française et à leur exécution par les Tribunaux compétents de Toulouse.
CONDITIONS OF SALE
STANISLAS MACHOÏR is an Auction House, registered under the number 2002/384 and regulated by the french law (July 2000).
- THE AUCTIONEER: will conduct the auction in French and in accordance with established practice concerning auctions. The descriptions in English are given for illustrative purposes only and in case of dispute the French description will prevail. The Auctioneer reserves himself the right to organize and conduct the sale, to modify the course of the sale, to withdraw any lot from sale, to bring together or separate lots. In case of a dispute, the Auctioneer reserves himself the right to continue or cancel the sale of a lot, or to put a lot back up in the event of conflict between several bidders. In case of several bids effectively recognized by the auctioneer, the lot will be put back up for bidding; all potential buyers may participate bidding at that time.
-CATALOGUE: The description in this catalog will be written in French. All lots are sold in current conditions. The description, general conditions, the verbal statement as well as the estimate given in the catalog are given as the expression by STANISLAS MACHOÏR of the perception of the lot but cannot constitute the proof of a fact.
-LOTS NON INCLUDED IN THE CATALOGUE: Some lots may be added to the sale without being included in the catalog. A supplementary list will be post during the exhibition and announced before the sale began.
-VIEWING : The viewing is open to the public. This exhibition allows bidders to appreciate and examine any condition of the lots. STANISLAS MACHOÏR is at disposal of potential buyers to provide reports on conditions of the lots. No claims will be accepted once the hammer falls. Any amendment will be posted during the public exhibition and announced before the sale begins.
-THE SALE : All potential buyers are request to register at the front desk at least an hour before the sale takes place. By registering, bidders agree to have read and accepted the conditions of the sale. A registration number will be provided allowing you to participate by bidding.
Any person is deemed acting on his own behalf except when prior notification, accepted by STANISLAS MACHOÏR is given that he acts as an agent of a third person. Bids can be executed at the sale’s room, by phone (telephone bids) or through the absentee bid form. Any person presenting himself as a bidder should have read and accept the terms and conditions of this catalog.
-COMMISSIONS: The Auctioneer will be pleased to execute Commissions, on conditions the lots have been viewing by the intended purchaser or his authorized Agent. Lots will be procured as cheaply as is permitted by other bids. All Lots bought on commission must be paid for within 7 days of the date of sale, regardless whether or not they have been collected.
-BIDDING BY TELEPHONE: STANISLAS MACHOÏR may graciously accept to receive bids by telephone from a potential buyer who has expressed such a request before the sale. Telephone bid orders must be submitted at least one hour before the sale. STANISLAS MACHOÏR will bear not liability or responsibility whatsoever in the event of telephone malfunction or when the communication breaks down. No guarantee is made as a result of orders received by mail, because of uncertainty about the security of the issuer.
-ABSENTEE BID FORM : This form is an authorization from the buyer to purchase under the best conditions on his behalf. This form should be accompanied by your ID, your bank details, as well as the maximum bid in euros for each lot (ex. Premium buyers and VAT). The absentee bid order form should be sent by fax or by mail at least one hour before the sale. If you are the successful bidder, we will contact you at the end of the sale. If the auctioneer receives multiple bid orders regarding identical bids, priority should be given to the first form received. Telephone bids may be arranged for lots with a low estimate of at least 1500 euros.
-SUCESSFUL BIDDER : The successful bidder is the person who brought the highest bid equal or higher than the reserve price (if stipulated). The auctioneer hammer’s stroke followed by the word 'adjugé' materializes the sale of the lot.
The full payment is the mandatory condition to deliver the lot to the successful bidder.
-CLEARANCE: Purchased Lots should be cleared on the day of the sale or the day following. Any Lot remaining o the Premises after 10 working days will be removed to the Auction Storage entirely at the owners risk and expenses.
- PACKING&SHIPPING: We do not undertake the postage, packing or delivery of items, but we recommend for such operations to be carried out by trusted collectors. If you wish to have your items for auction collected, we are happy to arrange this for you.
-RESERVE PRICE: All lots have a reserve price (unless the opposite has been established) which is the confidential minimum price below which the lot shall not be sold. Certain lots may be put forward without reserve and they shall be marked with an asterisk(*)followed by the sentence ‘sans reserve’. The Auctioneer decides at its sole discretion the starting price which is generally below the low estimate. In the event of a lacking of bidding, the lot will be withdrawn of the sale. In the event that a reserve price has been stipulated by the seller, STANISLAS MACHOÏR, reserves itself the right to bid on behalf of the seller until the reserve price is reached.
-SETTING A PRICE: The starting price is the starting point of the auction. There is no connection between the starting price, reserve price and the low estimate.
HAMMER PRICE AND THE BUYERS PREMIUM: The hammer price represents the last bid which marks the materialization of the sale between the seller and the buyer In addition to the hammer price the buyer’s agrees to pay STANISLAS MACHOÏR a premium of 24% on the hammer price (VAT included) on automobilia lots and 20% (VAT INCLUDED) for the motos and vehicles.
-PAYMENT AND VAT: The sale shall be executed in euros [€]. Anyone who is a bidder agrees to pay personally and immediately the total purchase price, as well as the applicable fees and taxes.
-BUYER’S PREMIUM: In addition to the hammer price, buyers agree to pay a Premium. (Decree No. 2002-210 – OJ February 19th, 2002).

An invoice shall be issued at the end of the sale. For absentee buyers, it will be sent by mail and by fax at the earliest and by post mail a day after the sale. VAT In the event that a lot might be exported to a country outside the EU, the owner shall notify the auctioneer as soon as the lot is sold.
STANISLAS MACHOÏR disclaims any responsibility for legal consequences of a buyer’s false statement.
-PAYMENT: By French check: STANISLAS MACHOÏR accepts only checks in euro. Lots will be only delivered after effective receipt of the payment. The transfer of ownership will be made by STANISLAS MACHOÏR after the total and effective payment.
a) In cash in euros within the following limits:
1000 € for French residents and traders (including fees and taxes)
- 15000€ (including fees and taxes) for all those persons not having its residence in France for tax purpose, upon presentation of official proof of identity and address.
b) By transfer in euros: our bank references will be given to the buyer directly.
All cost, such as bank commissions should be paid by the buyer.
-PRE-EMPTION: The French state has a right of pre-emption on movable property put up for sale at public auctions. This right shall be effective via a representative from the State. The State then replaces the last bidder and has 15 days to confirm the right of preemption.
-‘FOLLE ENCHERE’ PROCEDURE: Should the buyer fail to pay the amount due, and after notice, the lot will be re offered sale at the seller's request under the procedure known as procedure de folle enchère (irresponsible bidding). If the seller does not formulate this request within one month after the auction, the sale will be automatically canceled, without prejudice to any damages owed by the defaulting buyer.
-TRANSPORTATION: The removal and transport of lots purchased are the sole responsibility of the buyer. However, STANISLAS MACHOÏR may invoice to the buyer applicable costs of storage, handling and transport. STANISLAS MACHOÏR disclaims for any responsibility of the lot, as it is under the exclusive responsibility of the buyer. STANISLAS MACHOÏR will not be liable in the event or through theft, loss or degradation of any lot.
-INSURANCE: The lots acquired shall be insured by the buyer exclusively and immediately after the sale. STANISLAS MACHOÏR disclaims all liability for damages that may occur from the moment the sale was pronounced by the auctioneer.
-DAMAGES: Any person damaging a lot during the pre-sale viewing or during the sale will be held legally responsible.
INTELLECTUAL PROPERTY: STANISLAS MACHOÏR is the owner of the copyright in its catalogs. All illustrations, images and information provided by the seller may be used by STANISLAS MACHOÏR at its sole discretion in order to advertise the sales and the lots. Nevertheless, it is strictly forbidden to photograph or film the progress of the sale.
Photographs taken during the exhibition are permitted only for private use. Videos are not allowed.
-JURISDICTION All terms and conditions in this catalog are completely independent from each other. In case of dispute regarding its validity and execution, the parties submit themselves to French law and their enforcement by the competent courts in Toulouse, France. In case of conflict between the two versions, the text on French version will prevail.
